This website and its contents are owned by Birdhill Vineyards, “we”, “us”, and “our” refer to our commercial entity, and “you” refers to the person or entity using our website. By accessing or using this website, you agree to comply with and be bound by these Terms and Conditions of Use, together with our Privacy Policy and any other policies published on this site. If you do not agree with any part of these Terms, you must immediately exit and cease use of this website.
2. Updates and Changes
We may update, amend, or replace these Terms at any time. Amending terms will take effect immediately upon being published on our website. Your continued use of the website after any updates constitutes your acceptance of the revised Terms.
3. Eligibility and Responsible Service of Alcohol
Under Australian laws, it is an offence to supply alcohol to persons aged under 18 years old and for such persons to purchase or receive liquor.
You must be 18 years of age or older to use this website, register an account, or purchase any alcoholic products. By placing an order with Birdhill Vineyards, you confirm that both you and the intended recipient of the goods are at least 18 years old. We strictly support the Responsible Service of Alcohol (RSA) in accordance with applicable state and territory legislation.
4. Liquor Licensing and Delivery Restrictions
Liquor Licensing Notice: Wine and goods will be despatched by Birdhill Vineyards under Tasmanian Liquor License No. 103781.
We only accept online orders from, and deliver to, addresses within mainland Australia and Tasmania. Delivery couriers will not deliver wine to persons who appear under 25 years of age and cannot provide satisfactory, government-issued evidence that they are aged 18 years or over.
5. Website Use & Competitor Exclusion
You agree to use our website for lawful purposes only. Competitors are strictly prohibited from accessing or using our website, its content, or its digital assets to replicate, mimic, or compete with our business. We reserve the right to deny access to our site and may take legal action to recover any losses arising from unauthorized commercial use or data harvesting.

8. Product Information, Availability, and Pricing
We take all reasonable care to ensure that product descriptions, pricing, vintage details, and availability are accurate. However, errors may occur, and all information is subject to change without notice.
All orders are subject to stock availability. Birdhill Vineyards reserves the right to accept, refuse, or cancel an order at any time for any reason, including the unavailability of a specific vintage, an error in pricing or description, or an error in your order sequence. If we cancel an order after payment has been processed, we will issue a full refund.
9. Orders and Payment Security
All prices quoted on this website are listed in Australian Dollars (AUD) and are inclusive of GST. Applicable freight and handling charges will be calculated and displayed before you finalise your order.
Payment must be received in full via our secure integrated payment gateways before an order is dispatched. Credit card information is encrypted using industry-standard security protocols and is processed externally; your financial details are not stored on our servers. Once payment is processed, online orders cannot be altered or cancelled by the user. Please contact us directly if you need to amend an order within 24 hours of payment and we will endeavor to assist if the order has not yet been dispatched.
10. Shipping and Delivery
Deliveries are dispatched via Australia Post or designated courier services once full payment clears.
Estimated delivery windows typically range between 2 to 14 business days, depending on your location.
Risk and title in the goods pass entirely to you upon successful delivery to your nominated address. We are not liable for any logistical delays, product degradation due to weather exposure, or losses caused by third-party delivery providers once the goods leave our premises.
11. Returns, Faulty Wine, and Quality Assurance
Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law (ACL).
Defective Goods: If your wine arrives damaged, broken, or is chemically faulty (e.g., corked or oxidized), please contact us within 14 days of receipt at info@birdhillvineyards.com.
Quality Assurance Protocol: To implement our quality controls, we require that any potentially faulty wine be retained for review. Please safely reseal the bottle with the remaining wine using its original closure (screwcap) so it can be returned to us at our cost for assessment.
Change of Mind: Due to the premium, perishable nature of small-batch wine, returns or refunds are not accepted for change of mind.
12. Australian Consumer Law & Limitation of Liability
Nothing in these Terms seeks to exclude, restrict, or modify your statutory rights under Schedule 2 of the Competition and Consumer Act 2010 (Cth). Where permitted by law, Birdhill Vineyards’ liability for a breach of a non-excludable consumer guarantee is strictly limited, at our sole discretion, to:
The replacement of the goods or the supply of equivalent goods; or
The payment of the cost of replacing the goods or acquiring equivalent goods.
To the maximum extent permitted by law, Birdhill Vineyards is not liable for any indirect, incidental, or consequential losses, damages, or temperature-related spoilage arising from your use of this website or the subsequent storage of our products.
13. Privacy and Data Protection
We are committed to safeguarding your privacy.
